When one reads the "fine print" on your Cingular / at&t contract, you will see that you _only _get _one _new _phone _period. The one you buy.

Any replacement phone you receive as a warranty replacement is a used/refurbished phone. I have been told "many stories" by the reps, however it's better to share my true experience. Since I buy a lot of phones from Cingular from time to time I have had to send them back and everytime I end up with a refurbished phone.

It's also important for you to know that this is not unique to the mobile phone business or Cingular. It's the way the warranties are written, at least in CA.

Sometimes they look like new, other times they have marks/small scratches/etc. On those occaisions I have demanded a replacement that is cosmetically perfect, and they have sent a unit with a new housing. Much better.

It is what it is.....
